WHAT: Protest to demand accountability, transparency and reject the Attorney's General Mortgage Fraud Settlement. This deal is benefiting only the banks while making more money out of struggling homeowners. #FortHernandez demands to know why families like theirs continue to struggle and receive NO legal or financial benefit from this settlement!
The defense of the Hernandez home is entering is second week. The latest update from behind the barricades:
"We held a press conference today to update everyone on Bank of America's recent promise to "negotiate" with the Hernandez family: they ignored our calls.
Javier Hernandez spent over an hour talking to 6 various BofA representatives who passed him around, refusing to give last names or extension numbers. Bank of America continues to refuse to negotiate for a fair adjustment. Was that not a provision of the National Mortgage Settlement? The deal Attorney General Kamala Harris made is not being enforced, is not being followed up on. There is still no justice for struggling homeowners: there are increased foreclosures and short sales.
There are thousands of families like the Hernandez all over California. We can't turn to the elected officials, to the courts, or to the police for justice, we turn to the PEOPLE instead. Please take a stand with us against fraudulent foreclosures and the bank CEOs that remain wealthy while homeowners face evictions by sheriffs. GRACIAS"
The Hernandez Family were victims of a subprime mortgage, sold to them by Bank of America. Their story is a familiar story,
Bank of America got bailed out, the Hernandez family got SOLD OUT.
In February, State Attorney General Kamala Harris signed on to a nationwide settlement with BofA over charges of systemic and widespread mortgage fraud. For years, Bank of America has ignored the Hernandez' Family demands for an adjustment.
Now, after a week of occupation and eviction resistance, Bank of America has reached out to the homeowners for the first time! We demand that Attorney General Kamala Harris explain why she settled for a deal that continues leaving families like the Hernandez under threat of wrongful eviction and forced displacement.

>>>>>>>>Very FEW occupiers of #FortHernandez will be present at this event. #FortHernandez WILL remain OCCUPIED. Our FIRST priority is round-the-clock Cop Watch and defense of the Hernandez Family!<<<<<<<<
So, check it out: our Attorney Gerneral accepted 18 billion dollars from Bank of America, Citigroup, JPMorgan Chase, Wells Fargo and Ally Financia to aid our state's housing crisis and fund her "Mortgage Fraud Strike Force" that would investigate the fraud. Of course, if we had NOT settled, Big Banks would've had to face criminal investigation by the U.S. Department of Justice. And court.
Now, the settlement cash isn't even helping people keep their homes or solve our housing crisis; its going to short sales- another scam out of a scam that benefits Big Banks. Short sales are hard to explain but easy to find: just look for a foreclosed and abandoned house in your neighborhood. See how it sits there, empty for years?
And what of the victims of unjust eviction- those who already lost their homes? Under the terms of this deal, they would receive a one-time cash payment of up to $2,000 as compensation!
A key provision of the settlement is that borrowers will be able to refinance at today’s " historically low interest rates." Yet we are still enduring the nations highest foreclosure rates!
The Hernandez Family has seen NO benefit of this settlement, no refinancing, no negotiating. They are taking their fight to the responsible elected officials for siding with the BANKS instead of the PEOPLE.
